Types Of Custody Arrangements
There are many ways that custody can be set up between parents. The judge will consider what is in the best interest of the children when determining custody.
In North Carolina, there are two types of custody, legal and physical. They are defined as follows:
Legal custody: This grants parents the right to make important decisions for their children. These can include educational, religious and health care decisions. Legal custody can be awarded as either joint or sole.
Physical custody: This determines with whom the children live. Children may live with a primary parent for the majority of the time and have visitation with the other parent. Sole physical custody is necessary in cases where the other parent is absent or unfit to care for the children.
